TERMS OF USE

1. ACCEPTANCE AND ELIGIBILITY

By accessing or using CATCH ’EM, connecting a wallet, minting a Trainer NFT, opening a Hunt or claiming a reward, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the project.

You must be at least 18 years old and legally capable of entering into a binding agreement. You may participate only where the game, crypto-assets, paid entries and physical rewards are lawful for you. The project may restrict locations, wallets or users when reasonably necessary for legal, sanctions, security or integrity reasons.

2. AN EXPERIMENTAL GAME, NOT AN INVESTMENT

CATCH ’EM is an experimental onchain entertainment and collecting game. It is designed around Trainer ownership, paid Hunt entries, risk decisions, public scoring and possible physical graded-card rewards. It is not offered or promoted as an investment product, savings product, security, managed portfolio or source of passive income.

$CATCH and Trainer NFTs do not represent equity, debt, ownership of the project, a claim on treasury assets, guaranteed access to revenue, guaranteed utility, guaranteed liquidity or any promise of profit. Their market prices may be extremely volatile and may fall to zero. Do not buy, mint or play with funds you cannot afford to lose. CATCH ’EM does not recommend speculating on the price of $CATCH or any NFT.

Nothing on this website is financial, investment, legal, accounting or tax advice, or a recommendation to buy, sell or hold any crypto-asset. You are responsible for obtaining independent advice and for your own tax reporting.

3. HOW ROUNDS AND HUNTS WORK

Rounds use individually announced 24-hour active windows and do not automatically run every day. Dates, eligible Trainer collection, entry-price rules, scoring rules, tie-break rules, reward ranks and claim conditions will be published before each round. Do not participate unless you understand that round’s published rules.

Each new Hunt charges the displayed $CATCH entry amount plus network gas. Later PUSH and BANK actions in the same Hunt charge no additional $CATCH but still require an onchain transaction and gas. A failed transaction may still consume gas. A failed PUSH can zero the active Hunt as described by the applicable contract and round rules.

Scores and ownership are determined from the applicable smart contracts and blockchain records. The website is an interface and may display delayed, incomplete or incorrect data. Where the interface conflicts with confirmed onchain state, the onchain state controls to the extent permitted by law.

4. PHYSICAL REWARDS

A round may offer up to the number of physical rewards published for that round. Exact eligible ranks and committed cards must be announced before play begins. Winning is never guaranteed. A reward may require a timely claim, ownership verification, delivery information, sanctions screening and compliance with the published round rules.

Unless a round expressly states otherwise, the winner is responsible for customs duties, import taxes and any optional redemption or shipping costs charged by a custody or fulfillment provider. Delivery times, carrier handling, customs decisions and third-party custody operations are outside the project’s direct control.

If an announced card becomes unavailable because of loss, damage, fraud or a third-party failure before transfer, the project may provide a reasonably comparable substitute or another remedy required by applicable law. No uncommitted inventory preview is a promise that a displayed card will be awarded.

5. WALLET AND BLOCKCHAIN RESPONSIBILITY

You control your wallet, private keys, approvals and transactions. Never share a seed phrase. Transactions can be irreversible. You are responsible for verifying contract addresses, transaction details, token allowances, gas settings and the network before signing.

The project does not custody your wallet and cannot restore keys, reverse blockchain transactions, recover assets sent to an incorrect address or guarantee that a third-party wallet, RPC, bridge, marketplace or chain will operate correctly.

6. MATERIAL RISKS

Use involves substantial risk, including smart-contract bugs, exploits, malicious approvals, oracle or randomness failure, congestion, reorgs, forks, validator failure, RPC and indexer outages, incorrect displays, front-running, price impact, slippage, token illiquidity, extreme volatility, regulatory change, service suspension and loss of some or all amounts used.

Audits, testing, simulations, disclosures or prior operation do not eliminate these risks. Participation is voluntary and at your own risk, subject to rights that cannot legally be waived.

7. FAIR PLAY AND PROHIBITED USE

You may not exploit bugs, manipulate randomness or scores, interfere with infrastructure, impersonate others, evade eligibility restrictions, launder funds, infringe intellectual property, submit unlawful data, attack other users or use the project in violation of law. The project may pause interfaces, reject claims or disqualify activity supported by reasonable evidence of abuse, subject to applicable law and the controlling smart contracts.

Discoveries that could endanger users or funds should be reported privately through the official contact channel and must not be exploited.

8. THIRD PARTIES AND NO AFFILIATION

CATCH ’EM is an independent project. It is not affiliated with, sponsored by, endorsed by or operated by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK, Collector Crypt, Robinhood Markets, Robinhood Chain, Pons, Vercel or their affiliates. Pokémon and all related names, card images and marks belong to their respective owners.

References and links to third-party chains, marketplaces, custody providers, launchpads, wallets or card inventories are informational. Those services operate under their own terms and privacy practices. Their availability or mention does not create a partnership, warranty or responsibility for their conduct.

9. INTELLECTUAL PROPERTY

The CATCH ’EM name, original logo, site design, original Trainer artwork, text and software are owned by or licensed to the project operator, except for open-source components and third-party material identified as such. These Terms do not transfer intellectual-property rights to you.

You may link to the public website and share official promotional material for personal, non-misleading community use. You may not imply official endorsement, remove notices, sell copied project artwork or use project assets for fraud or impersonation.

10. AVAILABILITY, CHANGES AND TERMINATION

The interface may be updated, paused or discontinued for security, maintenance, legal or operational reasons. Future rounds are not guaranteed. Material rules for an already active round will not be changed retroactively except where reasonably necessary to address an exploit, legal requirement or event beyond reasonable control, and any response will be communicated as soon as practicable.

11. DISCLAIMERS

To the maximum extent permitted by law, the website, interface, contracts and related materials are provided “as is” and “as available.” No warranty is made that they will be uninterrupted, secure, error-free, accurate, compatible with every wallet or continuously available, or that any token or NFT will retain value or utility.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the project operator, contributors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss, or for lost profits, opportunity, data, keys, tokens, NFTs, market value or goodwill arising from use of or inability to use the project.

To the maximum extent permitted by law, aggregate liability arising from the affected service will not exceed the amount you paid directly to the project operator for that affected service during the three months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, mandatory consumer rights, or any other liability that applicable law does not allow to be excluded or limited.

13. DISPUTES AND CONTACT

Contact the project first through the official @catchemfun X profile so a private support channel can be arranged. Do not post wallet security information, identity documents or shipping details publicly.

These Terms preserve any mandatory rights and courts available to consumers under applicable law. If part of these Terms is unenforceable, the remaining provisions continue to apply to the extent legally possible.
